Zabbix 在中国持续可用的底层逻辑大揭秘

亲爱的Zabbix中国用户，

你好！为了消除中国现有和潜在客户、用户及社区成员对Zabbix在中国使用限制的担忧，我想对潜在限制和风险说明Zabbix原厂的看法和认识。

先说结论: 开源的Zabbix在全球可用。

最重要的原因在于Zabbix软件是根据GPLv2许可证发布的(https://www.zabbix.com/license)，这意味着以下几点：

世界上任何人都可以免费下载和使用Zabbix软件，而无需与Zabbix SIA（Zabbix 公司在欧盟拉脱维亚成立和运营）建立任何正式关系或签署任何合同。

这意味着官方法规和限制不应对获取Zabbix软件和合法使用Zabbix软件方面造成任何障碍。因此，Zabbix软件是开放使用的，无需与任何法律实体签署任何正式协议。

实际上，这意味着世界上的任何人都可以自由使用Zabbix，而不受地区之外法规的限制（如果您所在国家的法律不禁止您使用此类软件）。

根据欧盟出口法规

https://eur-lex.europa.eu/eli/reg/2021/821，Zabbix软件不能归类为军民两用物品，因为Zabbix软件属于“公共领域”。见以下摘录：

这再次证实了一个事实，即根据现行法律，对使用Zabbix等开源软件进行监管实际上是不可能的。

长期经验表明，免费发布的开源产品在世界各地都可以免费获得，并被数千家公司使用，包括Zabbix和Linux（都是根据GPLv2许可证发布）。

政治或经济法规不影响世界各地开源产品的普及或使用。

Zabbix是开源的，这意味着只要遵循开源许可和精神，任何人都可以对其进行扩展、改进和修改。

综上所述，这些事实使我们Zabbix原厂团队、中国的Zabbix现有和潜在客户、用户及社区成员坚信Zabbix软件是当今世界的最佳开源软件之一，完全符合监管、合规、以及自主可控。

A Letter to Zabbix Chinese  Users

To address concerns of existing and potential customers of Zabbix in China, as well as Zabbix solution users in China, and Zabbix community members from China, I would like to provide my vision and understanding of potential limitations and risks.

As most important, I would like to remind that Zabbix software is released under GPLv2 license (https://www.zabbix.com/license). Which means several things:

Anybody in the world is free to download and use Zabbix software without establishing any formal relationship or signing any contract with Zabbix SIA (established, and operated in Latvia, European Union). This means that bureaucratic regulations and limitations should not create any obstacles in obtaining Zabbix software and legally using Zabbix software. So, Zabbix software is open to use without need to sign any formal agreements with any legal entity. Practically this means that anybody in the world is free to use Zabbix regardless of extra-territory regulations (if you country laws do not prohibit you from such use of software).

According to EU export regulations (https://eur-lex.europa.eu/eli/reg/2021/821) Zabbix software cannot be classified as dual-use items, because Zabbix software is “in the public domain”. See extract below:

“GENERAL SOFTWARE NOTE (GSN)

(This note overrides any control within section D of Categories 1 to 9.)

Categories 1 to 9 of this list do not control "software" which is any of the following:

a.  Generally available to the public by being:

1. Sold from stock at retail selling points, without restriction, by means of:

a. Over-the-counter transactions;

b. Mail order transactions;

c. Electronic transactions; or

d. Telephone call transactions; and

2. Designed for installation by the user without further substantial support by the supplier;

Note:   Entry a. of the General Software Note does not release "software" specified in Category 5, Part 2 ("Information Security").

b. "In the public domain"; or

c. The minimum necessary "object code" for the installation, operation, maintenance (checking) or repair of those items whose export has been authorised.

Note:   Entry c. of the General Software Note does not release "software" specified in Category 5, Part 2 ("Information Security").”

Again, this confirms the fact that regulation of use of open-source software such as Zabbix is not practically possible according to current laws.

Long term experience shows that freely distributed open-source products, including Zabbix and Linux (also distributed under GPLv2), are freely available across the world and used by thousands of companies. Political or economic regulations do not affect popularity or use of open-source products across different parts of the world.

Zabbix is open-source, which means that it can be extended, improved, modified by anybody as long as it follows open-source license and spirit.

These facts lead me and hopefully existing and potential customers of Zabbix, Zabbix users, and Zabbix community members in China to the conclusion that Zabbix software is one of the best choices in the today’s world, which is full of limitation, regulations, and controls.
